Chief Justice Roy Moore Drops the Hammer on Sodomite Marriage Licensing in Alabama

Roy Moore is no stranger to the news, especially when it comes to the legal battles of Christians. Moore is most famous for his stand on a Ten Commandment monument. He has once again taken up the fight against sodomite unions in Alabama.

The Huffington Post reports:

The chief justice of Alabama’s Supreme Court issued an administrative order on Wednesday barring state judges from issuing same-sex marriage licenses, in contravention of the broadly accepted meaning of a June 2015 U.S. Supreme Court ruling.

Chief Justice Roy Moore forbade probate judges in the state from issuing marriage licenses that violate the state’s laws prohibiting same-sex marriage, “until further decision by the Alabama Supreme Court.”

Though I believe this is something that Moore should do, it is unlikely to have any real effect on sodomite unions in Alabama or any other state.  The reason is simple.  Most people have stopped following the Constitution and have exchanged it for Case Precedence.

The Post continues:

Moore said he was choosing to act now in part because the U.S. Court of Appeals for the 8th Circuit had recently found that the Supreme Court’s Obergefell ruling did not “directly invalidate” same-sex marriage bans in that circuit, and so there were grounds at least to hear the case. The 8th Circuit, Moore said, had nonetheless upheld the ruling on the basis of precedent.

But it is the interpretation of the 8th Circuit that has brought Moore to his conclusion. If the Supreme Court’s ruling was only for a number of states, and Alabama is not one of those states, they would be fully within their rights to ignore the ruling.

Fox reports:

Alabama Supreme Court Chief Justice Roy Moore cited conflicting rulings and said until they are resolved, a prior directive from March telling judges to comply with the state’s gay marriage ban would remain in effect.

He wrote: “Until further decision by the Alabama Supreme Court, the existing orders of the Alabama Supreme Court that Alabama probate judges have a ministerial duty not to issue any marriage license contrary to the Alabama Sanctity of Marriage Amendment or the Alabama Marriage Protection Act remain in full force and effect.”

It is unclear what this will change if anything. Many in Alabama are already issuing sodomites marriage licenses. And it is unlikely that they will stop based on this order, as a similar order had no effect on those same judges the first time it was given.

Fox reports:

He continued, “Many probate judges are issuing marriage licenses to same-sex couples in accordance with Obergefell (the Supreme Court case); others are issuing marriage licenses only to couples of the opposite gender or have ceased issuing all marriage licenses.”

Moore said the broader issue remains before the Alabama Supreme Court, “which continues to deliberate on the matter.”
