Once Again, the ATF usurps the Constitution to have Texas Man Indicted for selling over a Dozen Guns

A Texas man has been indicted after selling 13 gungs to an undercover agent with the unconstitutional Bureau of Alcohol, Tobacco and Firearms.

Kevin Joseph Pacacha, 53, of Corpus Christi, was under investigation by the ATF in April 2013, where he accepted a partial payment of metamphetamine for over a dozen weapons.

According to the DOJ’s website:

A federal grand jury has returned an indictment today charging a local man with possession with the intent to distribute methamphetamine and making a false statement on a firearms purchasing form, announced U.S. Attorney Kenneth Magidson along with Special Agent in Charge Robert Elder of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

Authorities had charged Kevin Joseph Pacacha, 53, of Corpus Christi, on April 14, 2016, following his arrest the day prior. He appeared in federal court April 19, 2016, at which time the court heard that law enforcement had been investigating Pacacha since 2013. Law enforcement believed he had been dealing firearms without a license. Agents met with Pacacha to notify him that he needed to obtain a federal firearms license if he wished to deal in firearms.

The government also detailed the undercover investigation that commenced following the arrest of a firearms trafficker in Brownsville in 2015. According to testimony presented in court, the undercover ATF agent allegedly made five separate purchases involving 13 firearms from Pacacha. At the time of the final sale, Pacacha also allegedly requested to purchase a large quantity of methamphetamine. According to court records, the undercover agent and Pacacha ultimately agreed to a deal in which Pacacha would provide four DPMS rifles and one LWRC rifle to the undercover officer in exchange for a half pound of crystal methamphetamine and $2,000 in cash. Following the exchange, agents arrested Pacacha.

“The tenacity and courage of the undercover agent in pursuing a suspect who seemed to have no regard for the ultimate destination of these guns highlights exemplary actions by ATF’s finest,” said Elder.

At its finest? Pray tell, where is the ATF found in our Constitution? Furthermore, what does, “the right of the people to keep and bear arms shall not be infringed” mean to the ATF? They are pawns of communists who are used to infringe on the rights of the people and their arms all the time!

Additionally, one has to ask why an unconstitutional agency such as the ATF continues to exist. We did away with prohibition, which was unlawful at its core, didn’t we? Why is there then a need for a central government’s usurpation of authority (something not given them in the Constitution) to regulate alcohol or tobacco, much less guns?

As for the methamphetamine charge, Pacacha is facing a minimum of 10 years to life and possibly a $10 million fine! Now, stop and ask yourself who offered him that? Was it not the lawless ATF agents? What charges are they facing for possession of such drugs? What charges are they facing for entrapment? That’s right, zero, zilch, nada. These are the same people who are aiding and abetting drug cartels while engaging in an unlawful “war on drugs.”

Everyone involved in the case, from the Texas Department of Public Safety to Corpus Christi Police Department Gang Unit to the Border Patrol and the U.S. Marshals Service should be held to account for usurping the laws of our Constitution that gives them absolutely no authority in this matter. In fact, apart from the meth issue, it reeks of the Randy Weaver story involving the same lawless agency.
