Legislator Proposes Bill to Hold Gun Sellers Liable for Criminals’ Conduct

Democrats and left liberals live in the land of absurdity. It’s not a physical place, but a place steeped in the mind where outrageous acts, sentiments and unjust laws are normal. In this mental place of absurdity, intelligence, common sense and critical thinking are non-existent; it’s a “go with whatever sounds good “emotional type of thinking.

Since the shooting incident of two reporters on live TV in Virginia, the push for gun control, a measure that eventually leads to gun confiscation, resurfaced with vigor because the individual who committed the crime passed a background check to obtain a firearm. In response, Sen. Tom Kaine (D-VA) is proposing legislation that would hold “gun sellers” criminally liable for the misuse of the guns purchased at the retailer.

Will this presidential election be the most important in American history?

The design of the bill supposedly “raises the bar” to require more accountability on the part of the gun retailer. Kaine’s proposed bill could expand the “federal reach” to private gun sellers meaning the feds could enact criminal liability charges against private sellers. Kaine’s bill, the Responsible Transfer of Firearms Act, proposes holding gun sellers criminally liable if the seller did not take “responsible, affirmative steps to determine the customer met federal criteria, according to a summary provided by Kaine’s office.

Currently, the law protects dealers from criminal prosecution unless the dealer “knew or had cause to believe the customer had a criminal record, history of mental institutionalization or other disqualifying factor.”

A statement by Kaine accompanied the legislation’s introduction. It states:

As recent tragedies in Virginia and across the country have shown, the gun laws in our country have done little to stem senseless gun violence. These numbing incidents in urban, rural, and suburban communities are made worse by the lack of accountability in those instances where the tragedy might have been prevented.

In regards to his bill, Kaine stated, “Ultimately, efforts to reduce gun violence must focus on multiple solutions. But this act is a step in the right direction.”

Kaine makes the case against gun control laws in the very first sentence of the statement accompanying his bill. “The gun laws in our country have done little to stem senseless gun violence.” As Second Amendment supporters have claimed all along, gun control does not stop criminals or individuals intent on committing criminal acts. Gun control serves to curb the law-abiding citizens from exercising their right to bear arms, which shall not be infringed.

If there is any doubt to gun laws not working, one only needs to turn their eyes toward the city of Chicago. In a city run by Democrats that enacted the toughest gun control laws in the nation, gun violence is rampant. Instead of blaming the laws infringing law-abiding citizens, Chicago officials blame surrounding areas its gun violence problem.

Gun sellers conduct federal background checks on customers at the time of purchase — a measure that is unconstitutional. A federal agency, the FBI, conducts the federally mandated background check. Yet, Kaine wants to hold the gun seller accountable for the actions of the buyer when the FBI cleared the individual for the purchase. Kaine is putting his “absurdity” thinking skills to good use as his proposal is absurd.

Using the “absurdity” thinking of Kaine, if an individual is killed by an automobile, the seller of the automobile is accountable — that would include incidences of drunk driving. The use of any object to commit a crime, using this absurdity, means the seller of the object is criminally liable. Instead of declaring an individual responsible for his or her own actions, the absurd thinking Democrats and left liberals blame the inanimate object and the seller of the object.

This begs the question: Under Kaine’s bill, would the government agency involved in the “Fast and Furious” operation be criminally liable for the deaths of the individuals killed using the guns the agency sold to drug cartel members using private gun retailers? More than likely, federal agencies are exempt when involved in “firearm sting operations” since Operation Fast and Furious served as a catalyst to propel gun control.

Breitbart News has previously reported that vast majority of public attackers and alleged attackers pass background checks for their guns. These include Vester Lee Flanagan (Virginia), John Russell Houser (Lafayette), Muhammed Yousef Abdulazeez (Chattanooga), Dylann Roof (Charleston), Elton Simpson and Nadir Soofi (Garland), Jared and Amanda Miller (Las Vegas), Elliot Rodger (Santa Barbara), Ivan Lopez (Fort Hood 2014), Darion Marcus Aquilar (Maryland Mall), Karl Halverson Pierson (Arapahoe High School), Paul Ciancia (LAX), Andrew John Engeldinger (Minneapolis), Aaron Alexis (DC Navy Yard), Tennis Melvin Maynard (West Virginia), Wade Mitchell Page (Sikh Temple), James Holmes (Aurora Theater), Jared Loughner (Tucson), Nidal Hassan (Fort Hood 2009), Jiverly Wong (Birmingham), Seung Hui-Chi (Virginia Tech), Naveed Haq (Seattle), and Mark Barton (Atlanta).”

While the same Democrats and left liberals provide “sanctuary cities” for illegal alien invader criminals — some have committed additional crimes — declaring them “dreamers” and declare all Muslims cannot be judged on the actions of a “few,” they judge advocates of the Second Amendment Legi and law-abiding citizens exercising their rights by the actions of a few. They see no hypocrisy in this at all. Most of the shootings occurred in “gun free” zones. According to Diane “Franken” Feinstein, individuals intending to inflict violence using a gun would drop his or her weapon and surrender when seeing no one armed in a gun free zone. How many times has that happened? Zero!

They stand on the law when it suits their purpose and call for its violation when it does not. These hypocrites rail about not violating their rights while infringing on the rights of others. By Kaine’s own admission, gun laws have done little to control gun violence. Moreover, those laws never will control any individual intent on engaging in violent criminal behavior. Studies show crime decreases as more individuals exercise their right to bear arms. This means little to those intending on disarming American citizens.

Using the mantra, “there’s more than one way to skin a cat,” the Nazi Kaine introduces legislation to target gun retailers. If an enacted law holds gun retailers criminally liable for crimes committed using a weapon sold from their establishment, gun retailers will close up shop preventing law-abiding individuals from making future purchases. Likewise, private sales cease as well if the law extends to that venue. Negating the fact the FBI, a federal agency, conducted the background check and passed the individual (again, unconstitutional), Kaine passes the buck to the retailer. If the FBI fails the individual on the background check, the retailer refuses the sale. So, exactly who should be held criminally liable under the unconstitutional background checks and Kaine’s unconstitutional proposal?

In the past, Congress rebuffed additional gun control laws and measures meaning Kaine’s bill faces an up-hill battle. But, Obama repeatedly declares using his “pen and phone” should Congress fail to act on any measure he wants, usurping authority for legislation where none exists in the office of the president. The UN Small Arms Treaty and the Trans-Pacific Partnership loom to be part of US law thanks to the Corker bill and Obama’s usurpation, meaning Congress essentially already delivered a striking blow to the Second Amendment without “passing” any legislation.

All of this is theater to gain the focus of Americans. While the Obama’s sycophant Kaine uses his proposal to gain the intense focus of citizens, what’s really going on that the administration and Congress hides?
