Biden’s Uniquely Unqualified ‘Diverse’ Judicial Nominees
“I have not had an occasion to address that.”
You probably saw this viral video of Kato Crews who spent four years as a magistrate judge, in which was likely an affirmative action/political favor, before being pushed as a federal district court judge.
Sen. Kennedy: “Do you know what a Brady motion is?”
Biden judicial nominee Kato Crews: “It’s not coming to mind at the moment … I believe that the Brady case involved something regarding the Second Amendment.”

This was a bad moment as even the media will admit.
Kato Crews, a magistrate judge in Denver who’s been selected for a district court seat there, couldn’t define a Brady motion and how to analyze it at his confirmation hearing on Wednesday.
The motion, enshrined in the landmark Supreme Court ruling in Brady v. Maryland, is a request by a defendant to compel prosecutors in a criminal case to turn over potentially favorable evidence.

Anyone can make a dumb mistake, but Kennedy is known for quizzing nominees and his question was hardly all that esoteric. Crews reaching into his memory and pulling out the Brady Bill would be fine for a layman, but a very bad look for someone angling to be in the position that he wants.
But really this was the much more damaging part of things.
Biden’s people are all in on equity and that means a manufactured demand for ‘diverse’ nominees whether or not they’re ready to go.
Crews isn’t. Neither was this legal eagle.
“Tell me what Article V of the Constitution does,” Kennedy asked of Spokane County Superior Court Judge Charnelle Bjelkengren during the Senate Judiciary Committee’s proceedings Wednesday.
“Article V is not coming to mind at the moment,” Bjelkengren responded.
“How about Article II?” Kennedy pressed.
“Neither is Article II,” Bjelkengren blanked, leaving Kennedy scratching his head.
Biden nominated Bjelkengren to serve as a federal judge in the Eastern District of Washington.
Kennedy then asked Bjelkengren, a graduate of Gonzaga University School of Law, to define “purposivism,” the method by which judges interpret statutes.
Once again, she was at a loss but tried to explain.
“In my 12 years as an assistant attorney general, in my nine years as a judge, I was not faced with that precise question,” Bjelkengren told Kennedy.
Biden’s people are rushing nominees through the gate and bragging about how they get more judges through the system than Trump (had 2022 gone another way, instead of being bogged down by garbage candidates like Mehmet Oz and Herscher Walker, this might not be an issue) but getting them in is only part of the process. Judges who are this basically ignorant are going to produce rulings that are not only bad politically, but bad legally, with bad consequences for the Left.
And it’s not just the judiciary.
