Everyone is awaiting the Supreme Court to render a decision in the King v. Burwell case that could effectively render Obamacare “gutted” because of the issue of subsidies being granted to individuals enrolled in the federal exchange. It has been reported in the news media and confirmed by Sylvia Burwell herself, the government has no backup plan in case Obama’s signature law is upended by a Supreme Court decision. But, in all honesty, when has Obama cared about any court decision issued against any of his “plans”?
A federal judge in Texas issued an injunction to cease Obama’s unilateral fiat amnesty, but as we all see, Obama is barreling full steam ahead with the funding provided by the impotent Congress. Obama will do the same should the Supreme Court rule unfavorably. If there is one thing you can count on Obama to do, it is to be consistent in lawlessness and ignoring court rulings.
Should the Supreme Court rule that the subsidies should not have been awarded, Obamacare is slated to suffer a huge blow. In anticipation of this and the fact that Obamacare has created hardships with health care insurance and health care in general, Sen. Richard Burr (R-NC) had previously drafted a potential bill, known as the CARE Act, that would provide an alternative to Obamacare and place the majority of responsibility onto the states for providing health care insurance to the uninsured while erasing the individual mandate and providing tax credits for individuals to purchase health care insurance.
Burr’s is not the only plan that Republicans have as an “alternative” to Obamacare. On Tuesday, Sen. Ted Cruz (R-TX) offered up his plan known as the Health Care Choices Act. Cruz’s proposed bill would allow individuals to buy health care insurance across state lines and repeal Title I of Obamacare that mandates the individual coverage, the insurance marketplace and subsidies. According to The Hill, Cruz’s plan joins a few others formulated by Republicans; however, Cruz’s has been more detailed, containing legislative text. The plan developed by three GOP Senators would allow “financial assistance” to allow individuals to keep their current Obamacare plans temporarily until a “state-based” solution could be found. In the proposed plan by three GOP House Chairmen, individuals would be provided tax credits in order to purchase health care insurance and allow states to opt out of Obamacare’s mandates.
According to Cruz, “Every last word of Obamacare must be repealed. And while we continue that fight, we must also send bill after bill to [Obama’s] desk to stop its harmful effects.”
Cruz stated, “The administration has done absolutely nothing to prepare for an upcoming Supreme Court decision that could leave millions of Americans unable to afford insurance thanks to this failed law. Republicans must offer the American people alternatives that lower costs and break the status quo that favors big government and big health care business over hardworking Americans.”
So far, Cruz’s plan has drawn five cosponsors, including Florida Republican Senator Marco Rubio. Companion legislation has been introduced in the House by Republican Rep. Marsha Blackburn from Tennessee.
You have to shake your head at the “little engine that could” efforts by Republicans who continue to grant Obama’s every wish after engaging in media “dog and pony” shows. Obama has basically engaged in unilateral fiat legislation in regards to amnesty. He relentlessly pursues this lawless avenue after a judge issued an injunction – all with impunity – while both chambers of the legislative branch provide funding for it. Do they honestly think Obama will abide by a Supreme Court ruling should it decimate the Obamacare subsidies? Will Congress withhold funding should the Supreme Court rule against subsidies allowed through federal exchanges?
The reason there is no “Plan B” in case of an unfavorable Supreme Court decision is because one will not be needed. Should the Supreme Court rule against the unconstitutional law, Obama will parade his mug in front of the media claiming that health care for the uninsured is the right thing to do, continually confusing health care with health care insurance. He will proceed forward through more “executive memos” claiming the court is wrong, he is right and millions of Americans can’t be wrong who are happy with their health care plans under Obamacare. Congress will engage in another dog and pony media frenzy, then continue to fund all aspects of this unconstitutional law. One can almost guarantee the Supreme Court, filled with Obama’s henchmen, will rule in his favor. So, either way, Obamacare with its subsidies is here to stay.
If by some odd chance the Supreme Court rules against the subsidies and Obama capitulates to the Supreme Court (unlikely), Republicans will face tremendous opposition for their “plans” in both chambers. There will be a tit for tat exchange with Democrats and amongst themselves. Eventually, Republicans will concede that their plan is inadequate, too much damage was done to fully repeal Obamacare, and Americans will be saddled with a Republican version of Obamacare or a single payer system, aka socialized medicine.
The states failed to use nullification at a critical time. Instead, states were bribed with additional federal funding or threatened with the loss of current federal funding. Extortion and coercion are powerful tools. Both chambers in Congress have failed to repeal Obamacare and the House has failed in their duty to issue articles of impeachment against Obama for usurpations of authority by engaging in legislative function and treason for aiding and abetting America’s enemies.
Republicans are engaging in activities to appease the voter base – nothing more, nothing less. Many Americans may cheer at this latest attempt by Republicans to offer some relief from the atrocity that is Obamacare; however, Republicans have disappointed time and time again. The judicial system has disappointed the public as much as Republicans, but have maintained a few bright bulbs to keep hope afloat.
The two things Americans can count on are the capitulation of Republicans and Obama’s continual lawless, criminal activity against the Constitution.
To put it bluntly, the US is on the pathway to socialized medicine and rationed care directed by unelected bureaucrats on a government panel. All of the gobbledigoop coming out of Washington is to try and lessen the blow. Government already has control of your health care and health care insurance. They are not about to let go, no matter what Republicans or anyone in Washington claims.
